I want it to be a stupid ref decisionThe rule is you've got to be in control of the tackle, and if you aren't and the studs make contact because you've overstretched then it's reckless and dangerous play. Jagielka is overstretched and he's studs up into the shin/upper ankle of the player, and had no control over the tackle.
So it's a definite straight red by that rule.
It's also definitely denying a goalscoring opportunity because the ball has ran loose and the oncoming player is in behind if he isn't taken out. Jagielka is the last man.

You have to judge it by how the game is, not how you wish it was. The rules are clear on it - it's a red card.
