Burnley Case

I wonder if at appeal we can argue that Burnley's losses were caused not just by our breach, but also by the league's delayed and poor enforcement of their own rules.

The line would hold that:

A) The Premier League's enforcement was delayed.
B) The league itself didn't know what the appropriate 'sporting sanction' should have been at the time. (They said it could be capable of giving a sporting advantage, but this ruling specifically says it did).
C) as such, it's impossible to know with confidence what the league table would have looked like at the end of the season.
D) so, other factors would've caused the relegation.

But, I'd be worried if I were the premier league as it leaves them wide open to people suing them as the regulator. Can of worms.
 
So alternate realities have a place in proceedings now, If Everton were deducted points then Burnley had a better chance of staying up, What actually did happen after our points deduction a loss to United followed by a run of 4 wins on the bounce, did we even counter their alternate reality by pointing out a fact of us picking up points after a deduction. An average lawyer could have won this case.
  • Nottingham Forest 0–1 Everton
  • Everton 3–0 Newcastle United
  • Everton 2–0 Chelsea
  • Burnley 0–2 Everton

Let's not complicate things, just tell it how stupidly it is, Burnley are suing us because of a choice the PL made in enforcing rules & applying punishments that everybody including Burnley agreed to

This is exactly what I was thinking. The whole season and our approach to it changes. Think we'd have still somehow found enough to stay up mainly because Burnley were and still are an absolutely crap football team.

We're being penalised for a completely hypothetical scenario that didn't and won't ever exist. What a dangerous precedent this sets for the Premier League. No doubt we will be the first and only victims of this.
