Burnley Case

I'm pretty sure I read that when purchasing the club the new owners either had an agreement that moshiri would be liable for any costs for Everton losing this case, or money was withheld from the sale for when the case was settled. If true then it stops the club being worse off for it.

Also psr rules included any legal fees. Scr if in correct doesn't include it so won't stop is from spending. If so at least finally a new rule benefits the club.

This could be so damaging to the prem though, opens up every team to seek legal action against city, loads of teams to seek legal action against Chelsea, some teams against forest.

Premier league is ran by bigger morons than Everton is and that takes some bloody doing.
leicester broke PL psr rules and avoided sanction because they were relegated and thus under the championship authority. So a precedent is there where rule breaking can occur with no reprimand.
 
Apparently a few journo's etc were part of a video briefing this morning from Everton. Listening to the Toffee TV live now about it, they were present at the briefing. It has been said that the appeal is 'well in progress', the Friedkins are absolutely fuming right now, and that their message is that "The premier league do not want this". Sounds like if this is upheld at appeal then the Friedkins will start legal proceedings against pretty much everybody to turn this into a farce. Sounds good! This is supported by the club statement which did sound very angry in tone.

Why have they allowed independent panels to be able to make punishments up is beyond me.
 
This decision is bound to take the wind out of our sails.

However, the bottom line is there's no way we'll suffer a £40M loss to Burnley and we have very rich owners who's responsibility is to spend and get us back to a top 6 club.

If they dont then you'll know they're fakes. So look at this as an opportunity to see what we really have here in governance terms and how ambitious they are.

What did it say about it being applied in the season of the breach?
"the purpose of a deduction of points is to redress the imbalance caused by a sporting advantage obtained by a contravention of the Rules. That sporting advantage should be addressed in the same season, insofar as that is possible. In the Everton FY22 Proceedings, that was not possible – for which we attribute no fault to Everton, the PL, or to the FY22 Commission."
 
That's another thing that I can't get my head around, why is it no other club as well ? Forest breached, think Leicester did as well, Chelsea's breach was massive but they blamed previous owners and got a £10m slap on the wrist, why is no one sued them for a much, much worse breach ? Why aren't we blaming our previous owners ? Why aren't the premier league taking some of the blame, it wasn't our fault we were not punished for the breach at that time, it was down to the premier league themselves. Seems every club will be laughing at our expense again.
You’d think that will be a huge element of our appeal

Absolutely incredible how all of this can be sorted as the Man City farce drags on.

Who or what is the Premier League commison making these decisions? Incredible that they always seem to go against us while City and Chelsea get a pat on the back.

In fact, didn't the Chelsea owners argue that they shouldn't be punished as it wasn't them in charge at the time? Why is the same rule not applied to us?
