Good point.Thats a grey area. Personally, I see the second amendment as the right of the people to arm in order to form a militia in order to overthrow a tyrannical government. It's historical precedent (maybe the wrong word) that's completely outdated and was likely included in the bill of rights in order to maintain the support of the southern colonies/states in the fledgling years of the republic. The northern states needed this guarantee to quickly organize a response to any British reprisals, the southern states needed it to quell slave rebellions. The different needs for 2A go to the fundamental heart of the divide in the Country that led to civil war and still persist today.
I think it should be amended to clear up the ambiguity that plagues the issue. I, personally, don't see the need for any guns in private ownership but I get that that's unrealistic. So perhaps, amend the constitution so that the 2A is clearer, safer, and easier to legislate for and implement.
For me, second amendment stands for everything that America is supposed to represent. For me, it's all about freedom. The 2nd amendment is supposed to empower the citizens and give the citizens the freedom. America was formed based on an uprising against a tyrannical regime and the ideas of 2nd amendment was fermented from this.The values of compulsory service in order to keep firearms (i.e. serve in a militia) is how this country was formed and is the basis of its identity? May I ask where you studied American history/civics/political science?
The modern interpretation is antithetical to the concepts of the Framers so cannot be "how America was formed" nor the basis of its "identity".
The Second Amendment says nothing about background checks or mental health screening. Right now I could walk across the street and sell my neighbor one of my shotguns and there's absolutely nothing preventing me from doing so. No background check or mental health screening is required.
