An assault on a police officer, falls under the Assaults on Emergency Workers (Offences) Act 2018. Previously an
assault on a police officer was charged under the Police Act 1996, however the new legislation was introduced to give the court greater sentencing powers. Assaulting a police officer is now deemed an aggravated assault and is therefore treated more seriously by the courts.
Section 1 of the 2018 Act states that the section
“applies to an offence of common assault, or battery, that is committed against an emergency worker acting in the exercise of their functions as an emergency worker”.
This is why the gender aspect of the crime is omitted, because it is a much more serious offence to attack an officer, any officer. It is right that this legislation exists. I understand the old school attitude of men shouldn't hit women, my points earlier in the thread were to acknowledge the above.
I'm frankly amazed he wasn't taken to the hospital under armed guard, checked out then put on remand. This could have been achieved had Rambo been removed from duty and arrested under caution at the same time for aggravated assault.
