It falls within the category of threatening. It has been reported that the traveller community will seek revenge, the same community then set up a ‘shrine’ opposite the persons house where other travellers will then visit. If you believe that it was non threatening then you are naive. However if you are so naive so as to truly believe that it was non threatening then I apologise.....
 
I’d suggest putting up flowers to mourn someone’s death , whatever I think of Act and whatever we all seem to think of the dead person, is pretty much never going to meet the criteria above .

Even if you say it does a google of the specifics of the offence , in relation to putting up a sign/notice etc .. says :


“A person is guilty of an offence under s.5 only if he intends his words or behaviour, or the writing, sign or other visible representation, to be threatening or abusive or is aware that it may be threatening or abusive or (as the case may be) he intends his behaviour to be or is aware that it may be disorderly.”

So I’d suggest that’s a non runner unless we’re suggesting the flowers are put up with that purpose . Certainly the ’sympathy’ cards I’ve seen in the media wouldn’t fall in with the above .

I’ve read that mate and I honestly think a card saying you’re the best daddy or whatever would struggle to meet the public order criteria . I’m happy for legislation to be used to take it down and there may or may not be intelligence that revenge is planned but who knows . I’d agree it’s a real possibility but it’s also a possibility it’s the media speculating .

I can’t believe , given signs that are displayed by extremists in this country on all sides that are deemed by the police and cps to not constitute an offence that flowers left at a memorial could cross that line .

I do think unless something is done You could see arrests , be it the people ripping stuff down or those putting it up. All of which is fanned by a host of photographers revelling in capturing them going up and coming down .

I doubt it; would not have been seen as fair, being such an age difference, there is a pretty strong honour system with what we settled see as just violence! Maybe with the family of thief who got himself killed, but not the wider traveller community, there will not be much sympathy if any. I suppose if they feel they are all being tarnished by this thief actions there might be wider anger.

His relatives turn up and make a shrine, not where he died, but facing your house. It doesnt bother you at all. Is that what you believe......

No I’ve not said that at all but From what I can find it about the intent and you’re never going to prove that are you? I can see your point to be honest but I’m not sure it’s the correct legislation although you could maybe make it fit. I can’t believe the council simply couldn’t order it removed though personally and the police maintain a presence to prevent any disorder .

"I hope you die you [Poor language removed]" is threatening. "Get out of the estate you nonce" is threatening. "I miss you dad" is not threatening, and isn't made threatening just because of its location or because someone else reads something in the Mail about it.

pete - has it ever occured to you that they can't put the shrine there because it is (a) private property and (b) still has a police presence?

Mate, I have smiled at people and they have taken it as a job threatening experience. Not all threats come with a poke in the eye......
 
The idea of creating a memorial or remembrance tribute to someone who was a suspected criminal seems odd.

He broke into private property, tried to steal and ultimately lost his life due to scuffling with the home owner after pulling a knife.

I get his family and friends want to honor and remember him but its kind of stupid and insensitive to erect it outside the place where he was in the wrong.

Even if it is genuinely a peaceful and purposeful way of showing respect to their friend it was always going to inflame the locals who are obviously friends and neighbours of the home owner Richard.

Who i bet is not coping well with the whole thing. Why should he be constantly reminded of it too.
