2 men broke into a house, one of them armed with a screwdriver forced the pensioner into the kitchen where they fought which resulted in the burglar being stabbed. The burglar escaped but later died.

The 78 year old has been arrested on suspicion of murder.

He hasn’t been charged yet and if the reporting is accurate you would assume he wouldn’t be .
 
Sorry mate but that is nonsense you have to investigate things properly you can just take it at face value

Of course. They have to follow procedure......he was already charged with assault, now of course it’s murder.......the original crime of breaking and entering with a weapon is ignored.......

Well, it is particularly hard to charge someone if they're dead, nevertheless I do not think that it will be being ignored by the Police and CPS.

There's two likely option:
  • he'll be released as the force he has used is proportionate to the threat he was facing - two intruders who are armed etc. etc. etc.
  • the home-owner will be charged as they've used disproportionate force - they weren't threatening life or he's been frenzied in his attack,
I have a gut feeling it may be leaning towards the latter as he's actually been arrested quite quickly; it could have been questioning under caution.

In such scenarios, the case of Tony Martin is often brought up as he was arrested, charged and eventually convicted of murder in a similar case.

However, he decided to let three rounds into a lad as he was running away and when injured climbing out of a window - that was disproportionate.
 
I thought it was the law you could attack them and it changed a few years ago if at home,if they are bad etc,not the mans fault the burglar died later
 
Yes, specifically the mans fault the man died later.
For defending himself in his own home,which i thought changed a few years ago to allow that,if attacked at home,so the way this works,almost like its ok for the owner to stand still and be attacked by the burglar with a screwdriver,if burglar died later on all his own fault for breaking in bringing weapon into that mans house,,,if he attacked him down the road etc and the man died fair enough but he did not,man should be free now,if someone broke in tonight armed etc, i would kill them if it needed done,wouldnt stand there and let them do what they wanted etc,you can imagine how scared the 78 year old would have been
