There is a clause indeed. The point is, Everton never seemed to formalize their offer in written form.

Therefore, without any proving document any offer by Everton wouldn't be binding for the buyer.

So it can't be binding to sporting when it comes to the compensation fee issue neither.

I don't have perfect knowledge of the clause, I just know it exists. At first I thought Sporting would have to pay 10% of the offer. Then in the press came that it was only 10%of the difference between the offer and the agreed limit of 15M €. For example, in a 20M offer the compensation would be 10% of 20-15=5...meaning, 500k payable in 10 installments.

So this news is something that shall be enlightened in the next few days.

It's getting hilarious. And a very stupid clause indeed. I hope he won't sign for us with some ridiculous clause that can be exploited. Remember it's the same agent we're dealing with.

I really don't think it is a clause that can be activated a million times unitl the player pays his contract. It must have some conditions to be activated.

But as I said, I'm not the lawyer who wrote the contract, so I 'm not in position to give any more accurate details.

And I agree with you, this whole crapp of the agent is something that can turn against us in some other moment further in time. This arses are ruining the game. Nowadays, a player is unsettled very easily because of this greedy bastards. Just remember the bung history over there in England. Absolute disgrace.

moutinho definetely on his way now trus me, yes that clause is true read:

Moutinho want 1.5 millions; Sporting refuses be paid it

There is an open war between João Moutinho and the administration of the SAD of the Sporting, that has in the base the different readings that the two part do of an existing clause in the contract that links the medium one to the club until 2013, related with all the proposals that appear for the purchase of the pair of the player.

João Moutinho and Sporting in open war ASF

That clause says that, case the lions refuse an equal worthy proposal or over 15 millions of euros, the administration of the SAD stayed obliged it refund the athlete in ten percent of the total of the invitation.

In the past Saturday (day 19), as the Sporting confirmed yesterday in notice sent to the CMVM, the agent FIFA, Pini Zahavi, simultaneously businessman of Moutinho and representative of the Everton in this operation, united with the administrator of the SAD, Miguel Ribeiro Teles, and with the sporting director Pedro Barbosa, for communicate that the English had the intention of pay 15 millions of euros by the pair.

The lions refused and said that alone accepted to begin to speech from the 25 millions of euros, or be, the constant value in the clause of rescisão — that already is not active (exhaled to 15 of June), but would be valid by means of the existence of an agreement between the part for the exit by these values.

From this moment, began the divergences between João Moutinho and the administration of the sporting society. The Sporting defends that any proposal made after 15 of June "should obey to determined requisite, what was not verified". By other words, the Sporting understands that the proposal of the English would have of be deed in writing. The understanding of the player and of his businessman, Pini Zahavi, is not that. For both, the Everton, that was officially represented by the agent FIFA, offered formally 15 millions and, as this invitation was refused, the lions will have of pay 1.5 millions of euros to the player, corresponding to the 10 percent of the total value of the proposal.

Therefore, in this moment, this is the budget that provokes the misunderstanding between the two part and that is in the origin of the earthquake provoked by the statements of João Moutinho in the end of the meeting with the Blackburn Rovers, in the which showed to firm intention of abandon the Sporting.

I don't have to sleep to dream, come on get him signed!

Jo-ow moo-teen-ee-oh

or, if you want to sound more Portuguese, just say his name holding your nose ;P

Sporting fans are going to think we're a right bunch of bastards... Can't see Moutinho being welcome back either.

We've turned into the big bully here like Utd with the Rooney deal.

I've never looked at us that way before (being a bully) but I guess there's a first time for everything.

Perish the thought. Everton being a bully??:D

Nice to feel a little intimidating every now and then isn't it?b)

I've definitely noticed that we're attempting to do a hatchet job on Sporting. To be honest it does concern me slightly as the one good thing that came out of the Rooney transfer was the thought that we not doing the dirty on anyone (but ourselves, perhaps).

Success in football thesedays though, seems to necessitate doing a deal with the devil.

So be it, unfortunately.

we seem to always get shat on, or lose players at the last minute, like sissoko when he joined liverpool right at the last minute.

Bout time we did some bullying for a change.
