Exactly. That was easy to quantify because West Ham fielded an ineligible player and that player directly influenced games which resulted in Sheff Utd being relegated.

There is no way of saying the same about our PSR breach. It's not like we went out in the January window and bought someone who scored goals to keep us in the league and that spend is what took us over the £105m limit.

It is impossible to categorically define that we received a sporting advantage let alone quantifying what that would have been.
Some could strongly argue that the money spent by Moshiri has actually had a negative impact on the club. I cantvsee how anyone can argue that the 17 odd million overspend has been any advantage to us on the pitch whatsoever.
 
The report said we did too.
There is an 'inferred' Sporting Advantage purely on the basis that we spent more than we were allowed. The report also said it wasn't quantifiable which basically makes a mockery of the 10 point deduction and claims for compensation.

A decent law firm would make sure this would go nowhere.

This is Everton though. Everton excel in cockups and will probably come out if it even worst.
 
If we get sued and they win do we break FFP, if the fines total enough. They way things are going and they way we are being treated, it wouldn’t surprise me.
If we get sued and they win.. then we declare administration and likley bankruptcy, whatever the outcome they won't get any money.
 
Poor old Derby County finished 3rd that year and lost in the playoffs.. they are in league 1 now could have gotten automatic promotion if Leciester didn't break the rules..
I hope our legal team are jotting down this long list of other clubs indiscretions over the years. They should be demanding an explanation of why we have been singled out for such a ridiculous punishment, when others have got away with slapped wrists.

There have been many clubs that breached financial rules but none have had points deducted (administration aside) it's only ever been fines Manchester United were fined by UEFA just 4 months ago for a breach of FFP.
 
I might be mistaken but i thought the report said sporting advantage was ‘inferred‘? If so, how is that proof?
Inferences will be made in murder trials etc, I don't think they've used it to mean they just shrugged and said 'pft, probably'. They've concluded that there was a sporting advantage.

It's weird, everyone seems to want a report which I presume all of us completely disagree with to say something it doesn't.

The whole thing is bonkers! All clubs suing each other for various potential outcomes that noone actual knows would have happened. I mean football is a mental game, points deduction one season can potentially galvanise a team and turn a few draws into wins and losses into draws. Someone please tell me when this suing merry goround would stop if clubs win claims against Everton. Chelsea and City and some others may aswell close up shop now.....

I would assume that fines would not get included in FFP, i mean even the corrupt PL are not stupid enough to classify a fine as giving any sort of sporting advantage....
 
Yes, thats the PL rules, that clubs "may" have a claim if a club is found guilty. So they present to the commission after a guilty verdict to see if they will award anything, the commission decides if they will award anything, and then regardless of the outcome the clubs can not sue or issue a claim in court. Thats all in the PL rules book and without looking up its history I suspect that all got added after and very specifically because of the West Ham situation.
Haven't read the whole book (who would( but downloaded it to check and their doesnt seem to be anything specific about this, it's very vague

I could of missed it though it's a long document
