Burnley Case

I think the basis for an appeal will be based on the jurisdiction of the timeframe of the breach. We've all accepted we were in breach.

Burnley were relegated in May 22 but by the rules we werent in Breach until the 30th of June 22 that year until the ned of the financial year. On the 1st of Juy that year we were in breach, but Burnley had already been relegated.

What the panel decided is that we were in breach for the whole year 21/22 season - even though we had from the end of that season until 30th of June 22 to not be in breach - Burnley had been relegated before that.

I think or best chance of clawing this back is this argument.

If they dont accept that argument - then anyone who has had to sell players to comply with PSR in recent years in what become to be known as the PSR deadline on June 30th- Newcastle, Villa, Forest, Chelsea and ourselves - would have been in breach for the entirety of those seasons to.

Slightly falls down when you understand that we won our appeal on the legal application of the commission in their decision, which reduced the points deduction.

But we failed on to completely overturn the ruling, because, we did in fact actually breach PSR.

And the appeal was only really considering the legal application and not whether we breached.
 
The irony in all of this, is if we had have spent the money and in fact gained a sporting advantage by finishing say 10th upwards that season.

Burnley wouldn’t have had a case.

Instead we got rid of all our best players, didn’t replace them. Narrowly avoided relegation.
Received 2 points deductions. Sold more players. Nearly went into administration.
And now Burnley have the cheek to sue us.

Inbred little bastards.

Burnley used,and are using,King and Spalding who are about 3 times the size of Slaughter and May measured by revenue.
 
^ Actually, I think this is with regards to appeal, but I knew I'd seen them in that doc.

I think we used Pinsent Masons and once we knew we were beat, we've brought Slaughter and May in which is their mention in the doc.

So it's not new news as the X post/article suggests.

Everton have also worked with Slaughter and May in the past.
What company did Shagger Silk work for, he ballsed up the previous cases.

You are calming this to a group of men who said Everton should have foreseen the war in Ukraine, they the pannel have an agenda against Everton I'm becoming more convinced of this.
