I'm not justifying it, my views are irrelevant. The best thing to do would be to read the reports. But the fact is the original report, and all of them since, have said there was a sporting advantage, and it obviously plays a large role in this new decision. It's always worth correcting people when they repeat the original misunderstanding though because the more people understand what's happened properly, the more people see why it's bad.
I thought the original report said that it could be inferred there was a sporting advantage but difficult to quantify what it was. In the absence of a codified set of sanctions they applied a formula they decided on(subsequently reduced on appeal) and have now decided on another formula that says our PSR breach was worth between 3.5 - 7 points over one season and we would have been relegated without it!!

The whole thing is a joke.
 
Why are you asking me?
I'm just interested in the supposed sporting advantage. Trying to get my head around it. If Everton had a net spend like Nottingham Forest did when they breached then I would get it. Forest seemingly broke the rules intentionally thinking they would accrue enough points to stay up regardless.
 
They better had or what are they doing owning Everton?

Time for these to show some muscle in the market place. £110M last summer was ok but nowhere near enough.

Has to be another £150M dropped this summer (1) of they're just here sitting on an asset and making sure its value is maintained (2).
1 - More chance of you juggling soot
2 - steadily increased
 
In theory can't our appeal be that the entire league season needs to be replayed to prove that this ruling is true. And then we refuse to pay until the entire season is replayed.
Not if I'm forced to watch the same players from that season with that manager. I'll chip in on the 40 million if that's the case.
 
Two points stick out for me.

1. The original ruling on the 10 point deduction said explicitly that we didnt gain a sporting advantage from overspending, didnt it? So if thats the case, how did we stay up at Burnley's expense from this overspend?

2. If this is a financial compensation case, surely every football result from now on can be prosecuted in court.
a) Can we argue that giving us 10 and then 6 deduction meant we played differently while we had those extra 4 points off our total, so maybe our league postion was affected so we can sue for the prize money we lost out on?
b) Can any club now pursue teams that finish above them in court? Can anyone who finished below Chelsea in their £10m fine season sue for the extra prize money?
That lunatic at Forest is going to be chucking lawsuits around all over the gaff.

Whole thing is a farce, double jeopardy, heavy handed and not in proportion the first time around but as a club we were an absolute basket case at the time of the first penalty and took it hard and dry with thanks.

You’d like to think with new owners, they will protect their investment and come out fighting so we will see how this plays out.

Hard not to argue with those who draw lines between the dots with the PL and our club. Dodgy decisions from referees, no pens, barely any VAR decisions, made an example on PSR then this…

“A series of unfortunate events?”

Or as others claim, retribution for standing up to the super league scabs?

That plus the likelihood of a Blue potentially ending up running the country who has previously made some strong statements about football governance and fairness. Perhaps the PL are getting all the digs in while they can?

Whichever the reality, we should go all out and look to bring the whole house of cards down as this will set a precident that throws Chelsea, City, Mancs and possibly others with skeletons in the closet into focus.

Everton appeal and win! The appeal is upheld and we dont have to pay £35m
***and they also rule that in future no clubs can sue other clubs in this way, to get financial rewards for theoretical sporting results ***

... ....

And then the Man City ruling comes out.
 
I would like to put forward a Man City conspiracy theory for piss boiling purposes

If Man City were found guilty, their case relates to 115 alleged breaches spanning from 2009 to 2018

Under English civil law (The Limitation Act 1980), the standard time limit to bring a breach of contract claim is 6 years from the date the breach occurred.

I wonder if this would be used as a yardstick by their panel…

Although you could argue that City’s concealment removes that barrier to compensation
