Yes, and they need to make that apology fast too. My hunch is that they dont like the competition and they dont want to admit that so have just criminally laced their correspondence with our friend with innuendo designed to make him go away quietly.

I cant get my head around this,i have met 3 of the people you mentioned in your post..i.e rowan,griffen and dickinson and this is not right the way you have been treated,i am in liverpool for 2 weeks over christmas and the new year and i will be meeting these 3 at regular times and i hope alan ball you dont mind but i will be bring the topic up to these fella....there are fans from all over the world look forward to your reports....sicken,gutted and very angry by the way you have been treated...

Whoever came up with the 'logic' of applying a ban to a man who is obviously an avid Everton supporter with a passion for youth football, needs to give their head a wobble.

Had they bothered to actually read any of the mans reports I wonder? Or was it merely the fact that by writing them he's somehow impinging on the clubs own social media activities / youth team reports?

It's a great shame & I really feel for the man involved here, as they're removing something that was dear to him & the inferences aren't acceptable either.

Internally it appears the 'logic' applied here has been justified all the way up to Elstone, however, Kenwright needs to know about this imo. You can contact him via his PA at his theatre company, send him the full story & see what you get back.

Agreed, you cant put broad terms likes "inappropriate contact" with minors in writing and expect it not to be an issue - in this case you can see the pure incompetence of our communications dept. Clearly no legal eye has cast their eye over that correspondence. What it implies is serious defamation.

I think Alan Ball has them bang to rights here, if it was followed up i can see them groveling.

Personally i wouldnt let this go, that issue is the smoking gun.

Unless the letter has been formally distributed to others then there can be no defamation.

More than anything this makes me feel sorry for you. You know I am a fan of your reports and really have an interest in who is coming through. We have traded a few messages on it. I always found them positive. I find the stance odd as they could do nothing but bring the club closer to the fans and fans more ingrained in the club.

I suspect something else is going on here......I see it not only a attack on you Bally but this website, has a youth player been hammered on here in a separate thread and complained and that's how this has come about. Im a bit hazy on UK law, particularly English law and really only AB knows the context, but im sure that letter was distributed to more then one person whether it be club officals or no, im sure FOI legislation means AB has a right to view any record held by him by the club - which may be libelous. Secondly you could argue that that club officals behaviour in excluding him for the reason cited could be construed as slander.

The law is plain mate, for defamation to occur then one person has to share their libellous comments with AN other, besides you & then you have to prove that their words are damaging to your reputation. I think that by sharing them on a website himself, then he's not got anywhere to go with that one imo.

In any case it's a moot point, as that form of litigation is cost prohibitive & not really where he should be heading here imo. As this is about the mans lifestyle being damaged by a stupid decision made by some [Poor language removed] with a bunker mentality & a head full of marbles. Kenwright is the correct route here, not the courtroom.
