First of all, gather information.

If a criminal offence committed, then it proceeds to PACE 84. She would not have been handed the job of doing the investigation without the proper training. At my lowly grade, HEO, we were still, after training, empowered to conduct interviews under caution (either taped or written) under PACE 84. I am in no position to know whether she has conducted any interviews under PACE, or not.

On occasions, after Investigators submitted the report to senior officers, the senior officers would contact the Police if the misdemeanor was of sufficient gravity, and the Police would conduct the interview under caution under PACE.

I reckon, as she's not a serving police officer not acting in the course of police activities, she's not interviewing people under PACE.

It would become a police matter if there were criminal activity though, as you rightly say..

I was not a Police Officer. I was a civil servant in a Management grade who was trained to undertake investigative work. The role involved investigating possible/potential internal fraud activities by staff in the DSS (Benefits Agency). The training went fully into PACE 1984 and all the attendant methods of interviewing. One case I was involved in for several months in London resulted in the Met Police arresting the guy, and my being interviewed by a member of Special Branch as, as well as internal fraud, the guy had contacts in a certain community that had direct links to an international criminal organisation. That was a VERY interesting investigation!
 
1. Yes she is. She has been taken 'off-line' to do the investigation. I was an 'Internal Investigator' in the Government Department I worked in. Taken off-line 100% to conduct any investigation.

2. An investigation is just that. Obtaining information, collating it all together, and submitting a report to senior officers. It is senior officers who decide if a criminal activity has taken place. If it HAS, then you move on to '3' below.

3 If it is deemed that a criminal activity has taken place, then matters proceed under PACE 1984 advising an individual of their rights, and arranging an interview under caution.

It is no more complicated than that. However, in the present case, it is very unusual that the Police have stepped in and stated what they have regarding the content of the report, before the report has been published. I believe the correct procedure should have been that a) the full report should have been submitted and published; b) in the light of the contents, the Police then consider whether the law was broken in any instance; and c) if the law was broken, then they proceed to taking what action is deemed appropriate in the circumstances.
So, hypothetically, if you were to do an investigation to try and find a benefit of Brexit, where would you start? :coffee:
