The present state of the SCOTUS debate is disgusting, on both sides. I don't like Biden's promise. When we let race/gender be qualifying attributes, we open the door to getting justices like Thomas.
Ginsburg was obviously one of the most qualified justices we've ever had. This is why she was the person that broke that barrier. Can we not simply agree that if we must vest this level of power in SCOTUS, that we owe it to ourselves that we demand that all nine justices be on the level of Ginsburg, Kagan, Scalia and Roberts? I want neither another Fortas, nor another Thomas.
I feel bad minimizing very competent people like Breyer, Sotomayor and Alito, but they just aren't in that league and I feel like someone has to say it.
The Republicans seem entirely comfortable with putting nine conservative copies of Fortas on the Court. That does not work for me, at all. If we're going to let nine people settle issues like reproductive rights, I for one would like all nine of them to be people that intellectually deserve the right to lead the discussion. Explicitly selecting on race and gender limits our ability to appoint the flat-out most qualified people.
In a truly just world, both sides would insist that a vacancy remain open until someone worthy of the chair appears. This does not happen due to narrow interest politics. I suppose that this is what electoral systems are supposed to do, but this lays bare the problem with having appointed representatives select the 'best' people for an influential job with guaranteed lifetime tenure.
