We are in a brave new legal world here. The president has John Marshall and stare decisis on his side. It doesn't necessarily follow that the Supreme Court will back him up on this, though. They could overrule his tactics, and say that this one has to run through Congress due to the interstate commerce clause. I think Roberts will play ball. I'm less sure about Kavanaugh.

That's one way to think about it. If so, he'll vote with Roberts, since the mandate is solving a lot of corporate America's legal headaches related to COVID.
