He was just trying to waste time on the film and having looked at the clubs he played for he should be an expert by now....

He knew he was banged to rights and I'm sure the appeal will be against the sentence rather than the verdict.

Being well over the limit is totally indefensible and I as with others here hope they at least double his sentence.
 
I hadn't thought of that... If he pleaded guilty then on what grounds is he appealing?

That the sentence was too harsh.

If a 50 year old bloke gets done for drink driving, you can bet your bottom dollar its isnt the first time he has done it. Think about it; a day at the races, for many, means a day on the ale. He was most likely there in some work capacity, and the course cannot be that far from his house.

Taxi? Nope. I will drive. Serial offender, nailed on.

Just trying to avoid jail now. Not an expert, but unsure what grounds there are for another judge to effectively say that the other one was wrong.
Something will pop up... Probly the way he was dealt with by the arresting officer.. Perhaps he'd done to many hours that particular shift or something just as inconspicuous

Like I said, no expert, and get where you are coming from. But he isnt appealing the conviction, he isnt having a re trial, so I am not sure if the judge would even hear any evidence of police cock ups, even if there were some.

He will just end up with a hefty fine and probably a 2 year driving ban.

Very unusual to be jailed for drink drive unless there are aggravated circumstances.

he wasn't jailed for drink driving

he was charged for failing to provide a specimen

and the reason he failed to provide a specimen is because he knew he would be over the limit

i believe he is now trying to suggest that the medication he uses for arthritis or something mixed with the 1-2 pints caused some weird side effect to his body that may have given a false reading on the breathalyser machine which is probably why he was reluctant to provide a specimen

its just a sham and the first judge saw through it, hopefully the appeal judge will as well and he will get a harsher sentence
