This is ridiculous. Burnley are arguing that on the balance of probabilities, if the points deduction had been applied in the season that the breach occurred then they would have stayed up. But the points deduction could never have been applied until the following season at the earliest as the financial year for that season does not end until 6 weeks after the season is over

Therefore it is an impossibility for the points deduction to have been applied that season and keep Burnley up, so Burnley's argument is that because something that was impossible did not happen to save Burnley from relegation, Everton have to pay 40 mill in compensation and some idiot on a panel agreed with that

On the balance of probabilities, If you arrest a murderer before he goes murdering people then all of the people he murders would not have got killed. Does that mean that the families of the victims sue the police for not arresting the murderer whilst he was still an innocent person?
They made the argument about the points deduction but it wasn't accepted by the panel.
 
Ha, yes and all that lost CL revenue we cost them

Slightly unrelated, but a 100% true story.... a good few years ago Inwas driving home from work. I went into the left filter lane before some traffic lights. A woman pulled right across through queuing traffic to enter a car park, right across my path. She hit me.

Anyway, she was meeting friends in that car park and they acted as witnesses for her. Her claim came through .amd after some investigation by myself, as my insurance team were absolutely useless, I found oit that she was claiming for loss of earnings for her, her partner and her 16yo son.

Neither she, her partner or her son had jobs. She was basing her claim on the inability of her or her partner being able to travel to the job centre while their car was in for repair. And her sons loss of earnings based upon their belief that he would suffer trauma from the crash which would therefore effect his ability to maximise his GCSE results, potentially preventing him from following his dream of working in medicine.

Anyway, this Burnley thing stinks a bit of that palaver

The club should be doing everything in its powers to get this overturned.
Specifically until the Man City & Chelsea outcomes have taken place.

Whats next ?
Clubs claiming any points we have taken in that season directly impeded them getting more points finishing in higher league prize money , European monies , League winnings ?

Fight it to the death.

I think the interesting point is not based on probability, but on fact. We had some of our motley impressive results in the games immediately following our initial points deduction. Those results effevtively negated the points that were taken from us. Or, is Burnleys argument based upon removing the points from us post season?
 
Someone needs to remind the six fingered yokels that they got a nice fat parachute payment for going down in 22, which allowed them to win promotion as champions in 23, then another one for going down again in 24, which allowed them to gain promotion again in 25 only for them to be relegated for a 5th time from the PL in May that will land them another parachute payment to go for promotion again next season
And 6 play off spots now.

It gets worse mate, the interest they charged on the settlement is about £10 - £15 mill, the actual settlement is lower- they've charged interest on "Burnley's loss" and its impact every year since 21/22.

No settlement
No further admissions of guilt
We've served our punishments ( twice )
Let them take the PL to court

Get this overturned or forever be the whipping boys of English football.
 
Is this legit?
How, the [Poor language removed], does this make any sense when the Premier League bylaws literally states teams can't sue each other??
