What happens if they decide arbitrarily to take points again as a punishment? Do we then have two appeals on the go? At what point do punishments end up considered factors in games? By that I mean how does Dyche motivate himself and the side in the face of such spirit crushing atmosphere downer?

My read is, the club got nailed on the charge in March, we were over arrogant and thought we could explain it away at the commission, made no allowance for it during the end of the financial year 22/23 in our calculations- so essentially carried over the breach and we’re getting nailed again for it.

There is loads of fault to go around here, PL - no one saw a -10 unprecedented points deduction in their wildest dreams for essentially what is an argument over an accounting allocation of an interest payment - even more Stupid is we are being charged again for the same failing.

The club was arrogant not to take the charge into account for its 22/23 calculation, they can’t say they weren’t warned the charge came in March.

Where do we go from here, the outcome of both charges rest on the appeal in my opinion, one result will dictate the other.

The PL have fkd the league, essentially there will be no sporting outcome to the relegation battle this season, no last day drama, the outcome of the league this season will be decided by old men in suits sometime in May - death knell for the league, it’s not sport anymore.

Think Forrest are also Fd, as far as I can see their breach is far more serious then ours as it influences a sporting outcome. Be amazed if they aren’t nailed by 10 or more points.

All hinges on the appeal for me and absolutely no point speculating because the whole thing is being made up by the PL as they go along, absolutely no due process or guidance.
Yeah the charge came in March, but even at that point, there was disagreement over how much we had breached by (with us arguing it was only £9/10m). It also only gave us 3 months to get in line for the year we are now being done for and considering we had already sold Gordon, I’m not sure it’s arrogance.
 
They deliberately and knowingly breached in order to get a higher price later in the window. Correct decision for the club finances for sure. But for PSR it’s deliberate breach with sporting advantage (he played for them and by breaching they received more transfer money, thus improving the playing squad this year). Either way it’s bollocks, but that is a worse crime than us in the eyes of PSR because it was deliberate rather than incompetent. Madness.
I don't know where I stand with this. In some ways it ensured that their club remained sustainable and as such met the objective of P+S. Should they be let off for essentially delaying something to meet the objectives of the rule?

I some ways it's similar to us, in so much that we will have clearly shown we are traveling in the right direction with the club posting a profit. Whilst (potentially) still technically being in breach.

The trouble is, we took the view that it wasn't worth taking the risk with Richarlison and sold him before the deadline. So they've had an unfair advantage.

The whole thing is a complete mess. Why should 14 clubs also have the added disadvantage of having to sell by a different deadline to the wealthy 6 clubs? This puts Spurs etc in a far more advantageous negotiating position.

But how hard is it to pick the phone up and say, look we have this interest charge this is what we’re doing with it, what way should we treat it, once is careless, twice is stupid.

Not being binary here PL or the Club because this process is absolutely being made up as they go along - but there is fault to look at internally also - why tempt faith twice - it’s stupid.
 
It's pretty obvious we are the sacrificial lamb the PL are offering up to fight off an independent regulator.

It would be quite ironic if our ridiculous double jeopardy situation and the likely legal chaos at the end of the season is finally what makes the regulator happen.

Saw a report that Forest breached by 12.5m so should be under 10 points

telephone call on 9 December 2022 from Mr Herbert to Ms Charles. Mr
Herbert reported that the Premier League Board had considered carefully the
exclusions sought by Everton but had concluded, provisionally, that none fell
within a proper application of the PSR.

We just ignored it.
 

Everton could have avoided the initial breach by selling a player or two and replacing them with the most promising academy products, but decided to blag it out instead and got caught. Then in the following financial year, when they know they need to bring themselves back to the right side of the divide, they could have decided to sell a few players in the last transfer window, but again - ridiculously - decided not to do that.

Everton are basically the guy who buys 20kg of luggage on a Ryan Air flight, then stands arguing the toss at check in because they are getting charged £60 extra because their bag is 25kg. Then does exactly the same on the way home.

Just sell Michael Keane, Youseff Chermiti and Ben Godfrey, put an end to this nonsense.

This is the thing, we thought we’d get away with it…..once is stupid, twice really is unfogivable.

Im in no way not backing the club, but ffs, we have threads talking about board incompetence and critiquing Moshiri - this is just another massive example of him and how he fd the club. Not giving a flyer and reaching for an MSP or 777 parachute as he jumps out of the plane.
