Why not go a step further and wait for them to open fire before using lethal force?

Even better, we can wait to see if the person who's been shot dies.

This could take a while, days even, but until there is confirmation that they're dead then the police cannot open fire.

I think this is only fair, it also has to be the same type of weapon, be it a gun, crossbow or trebuchet.
