From my limited understanding, this act states that business owners etc can claim directly from the police for damages caused by riots. Therefore the state is not keen to label things as riots because they'll be on the hook for damages.
No cant agree have had look at Sky and others and they use Riot consistently. Besides "BBC News" is separate from the rest of BBC and should report unimpeded of state apparatus.
(6)In this Act, “riot” is to be construed in accordance with section 1 of the Public Order Act 1986
To be guilty of the offence the defendant must be with others who are using or threatening violence and the defendant must have either:
- personally used violence; or
- aided, abetted, counselled or procured the use of violence so as to be jointly liable, e.g. encouraging, planning, directing or coordinating the activities of those involved in violent action.
Charges under section 1 should only be used for the most serious cases usually linked to serious outbreaks of sustained violence.

It states in section 1 paragraph 6 of the act:

Which also means more than 12 persons present together committing unlawful violence etc.
If you actually look at the act, and what these parties who have been remanded to appear at Crown Court, at the moment they're all being charged for individual offences and section 2 violent disorder.
