Everton embroiled in this. Rapid are looking for the last installment of their payment from the oldco Rangers for Jelavic. Rangers are still chasing Everton for the £5.5M we agreed to. FIFA look likely to step in on Rapid's petitioning.

From that piece it sounds like Everton have just drawn a line at whatever they paid the oldco and wont recognise this newco...something that goes to the heart of the Naismith signing too.
 
Confused, maybe I'm bringing US bk law into a situation that doesn't fit, but if oldco owes the debt, and Everton owe oldco, Everton still pay oldco and oldco distributes payments to creditors (Rapid).

It's complex for Green. He seem to want to play the oldco card when it suits him but avoid any upcoming sanctions and fines that might entail.

The danger for Everton here is if FIFA cut the Gordian knot and say: well you pay them, and Rangers can pay Rapid, and Rapid can pay his original Belgian club. And what implications that recognition of Rangers and Oldco would have on any Naismith judgement.

I'm amazed we didn't try and settle with the administrators for a one-off reduced payment or I suppose maybe did , I wonder if we'll try and reach an agreement over payments ?

I know nothing but a counter question would be if oldco no longer exists how can Everton pay them?

EVERY transaction Everton have had with that club has always been complicated. They are a nightmare. I wouldn't know how this will pan out, tbh. Green isn't a stupid feller though and he looks in it for the short-to-medium term as far as I can tell.

I honestly dont think we'll get out of this by just handing a couple of million over for two of their players.

You'd hope the Jelavic money is at the moment 'ring-fenced' considering we expected to pay it (obviously I'm aware this is everton) & on the other players I still think it'll be ok as im confident we won't be charged at a maximum (which personally I don't feel will happen anyway) & even if we were that's what about £1m or perhaps £200k less ? The legal advisors for Everon, stoke, Norwich , Sion & whatever Turkish club MacGregor went to are all relatively confident to it seems and that's despite southampton's panic & I'd hope those legal teams are a lot mire qualified than us to judge.

The old company was liquidated & therefore I do not see how Green can have any interest in the debt owed by EFC to the oldco. Presumably that debt is factored into the administrators final calculations as to what the oldco creditors will recieve.

Green is either being poorly advised or he's a prize plum imo.
