Morning Mascoteers,

I hope you are all fit and well and looking forward to the return of football .......did it ever go away?

Raining here again , that raindance I did was really effective - must send the rcipie to @Gwladysover .

So Friday is the Jazzy household day for housecleaning so that's first on the agenda for today. My much awaited ( hope you are getting the irony ) 2nd load of gravel arrives at lunchtime so no doubt I will be expected to spend a couple of hours spreading that .....however , in a major concession , Mrs J says I don't have to work until it's dark and that I can stop at 4pm and she will take me down the pub for my tea ...yipee!

It is truly amazing what @anjelikaferrett has done to keep Cookie alive - I hope your friend appreciates it and brings you a nice pressie.

So last friendly tonight against Kiyv , I know for a fact that Evertonians will behave in exactly the right way.

Hope you are all looking forward to and going to enjoy the weekend , BTW where's Sassy? Hope she's not tied up again .

I have fitted the oars and they worked a treat they are scalloped on one side so that makes them "handed " and of course I took time to fit the rowlocks because of that and yes one needed turning over ! Who said the older you get ? The one thing in life I am justly proud of is the fact that if there is a chance to make a mistake ,I can grab it with both hands .
 
Rooney/Vardy judgment expected today. I'm looking forward to the judgment!
Should be a very interesting judgment both from a gossip magazine and legal point of view.

I've followed bit of the case and I've got a feeling from the snippets that I've read that Rooney's legal team made have made a basic error in the pleadings ( initial Court document and in her case defence )

It has emerged that the leak came from Vardy's agent , either directly or indirectly from Vardy.

Normally the Defence would plead that the action was caused by the claimant ( or their servant or agent ). If you can name the servant or agent then you might consider a 3rd party notice. Based purely on the snippets I've heard it sounds like the Defence simply alledges that Vardy leaked it herself ( which seems at odds with Rooney's original message "it's Rebekah Vardy's ACCOUNT - not you will notice ...it's Rebekah Vardy")

Vardy's legal team seem to be happy to pile the blame on her agent which they wouldn't do if the defence was framed in the way I've suggested.

Morning all, another sunny one. Sounds like a busy day @jazzy, enjoy your tea at the pub. The recipe for rain would be much appreciated as long as it doesn’t involve undressing and doing a rain dance lol. I think even if Rooney loses, ( which I hope she doesn't) she will have won in terms of reputation because Vardy has just trashed herself in the proceedings and probably ruined her husband's career as collateral damage. I reckon the judge will say they have to be responsible for their own costs.

Absolutely correct. I suspect that in the eyes of the public they've either bost lost or its a narrow win for Rooney.

Either way both will be substantially out of pocket as the judge has already said this should never have come to court and yes that should be reflected in a costs award but also , if Vardy wins , in an humiliatingly small damages award.

The other thing about costs ( and this is a bit technical , sorry Anj ) is that properly advised and if she takes the advice Rooney is likely to have made a Part 36 offer to settle. This is "without prejudice " and in no way reflects "guilt" but she may well have offered Vardy a paltry amount - say £10 k to settle the case. If Vardy fails to beat that offer in any court award she ( Vardy ) will be ordered to pay costs for both parties from the date of that offer.
