we made an offer and they have accepted it publicly. Nothing has to be in writing in the world of contract law, it just helps for proof. But if you want proof you just go on their official website.

Sheffield United can confirm that the club have agreed a deal with Everton for the transfer of Kyle Naughton.

But the deal is still subject to the player's agreement.

Hmm. I won't pretend to know anything about contract law, mate. But until something is signed, I'm confident that Sheffield United still have the rights and final say over Naughton's contract.
 

I think it will be a verbal agreement. I doubt Everton have any rights other than those which Sheffield United give them, which apparently they've just withdrawn.

I know that quoting it wouldnt stand up in a court of law but this is a snippet of wikipedia from the article on offer and acceptance.

Test of acceptance

Acceptance is a final and unqualified expression of assent to the terms of an offer.[11] It is no defense to an action based on a contract for the defendant to claim that he never intended to be bound by the agreement if under all the circumstances it is shown at trial that his conduct was such that it communicated to the other party or parties that the defendant had in fact agreed. Signing of a contract is one way a party may show his assent. Alternatively, an offer consisting of a promise to pay someone if the latter performs certain acts which the latter would not otherwise do (such as paint a house) may be accepted by the requested conduct instead of a promise to do the act. The performance of the requested act indicates objectively the party's assent to the terms of the offer.

The essential requirement is that there must be evidence that the parties had each from an objective perspective engaged in conduct manifesting their assent. This manifestation of assent theory of contract formation may be contrasted with older theories, in which it was sometimes argued that a contract required the parties to have a true meeting of the minds between the parties. Under the "meeting of the minds" theory of contract, a party could resist a claim of breach by proving that although it may have appeared objectively that he intended to be bound by the agreement, he had never truly intended to be bound. This is unsatisfactory, as the other parties have no means of knowing their counterparts' undisclosed intentions or understandings. They can only act upon what a party reveals objectively to be his intent. Hence, an actual meeting of the minds is not required. Indeed, it has been argued that the "meeting of the minds" idea is entirely a modern error: 19th century judges spoke of "consensus ad idem" which modern teachers have wrongly translated as "meeting of minds" but actually means "agreement to the [same] thing".[12]

This requirement of an objective perspective is important in cases where a party claims that an offer was not accepted, taking advantage of the performance of the other party. Here, we can apply the test of whether a reasonable bystander (a "fly on the wall") would have perceived that the party has impliedly accepted the offer by conduct.
 
Balggy, you're probably right in principle. I've a feeling Sheffield United could easily wriggle out of things, but I'm hardly an expert. You seem to know what you're talking about, so let's hope you're correct.(y)

If he goes to Spurs, he'll go the same way as the Hutton, Bale and the rest of their young promising British talent.

If we sign him, sound. £4m to 6m for a 20-year-old Championship right back with 40 odd games to his name...

Plus, he's having a medical today, according to someone at Evertonfc.com's forum.

EVERTON officials were in shock today after Sheffield United staged an astonishing about turn that has threatened Kyle Naughton’s dream move to Goodison Park.

As revealed in Saturday’s ECHO, the Blues had agreed a £5m fee with United and personal terms with the right-back but were rocked by late interest from Tottenham and Aston Villa.

However, United had released a statement on their official website confirming that they had agreed a deal with Everton and indicated they wanted Naughton to go to Merseyside, given the success Phil Jagielka has enjoyed since he made a similar move in July 2007.

Everton were anticipating that Naughton would arrive on Merseyside for a medical over the weekend and were confident of being able to have him on board for next week’s trip to the United States.

But Spurs subsequently made an improved offer to Bramall Lane’s money men that has dramatically changed the landscape.

United are now refusing to talk with Everton – nor will they let Naughton speak to anyone at Goodison – because of Harry Redknapp’s late attempt to hijack the deal.

Not surprisingly, Everton’s hierarchy are furious with United’s conduct, as they genuinely believed Naughton was on his way to sign for them.

Though hugely frustrated by United’s volte face, Everton still hold the trump card in the fact that Naughton, who played his last game for the Blades in their 1-0 win against Floriana in Malta on Friday, has made it clear that Goodison is his favoured destination.

Am I the only person in the entire world who doesn't have a source at the club? I think if you went deep into the Amazon jungle and found a tribe that has previously been totally cut off from human civilisation, that has it's own language, culture and laws based on been isolated for thousands of years, one of them would still say "Defour in January. It's been agreed - I know a guy" while tapping his nose.

It still says we've had the offer accepted on their OS, why are folk freaking out? Did it get pulled earlier or something?
