I presume this states rights argument is going to be ditched the moment women start travelling to states that still respect the right for a woman to have an abortion?
California is gearing up on the assumption not but if the GOP sweep both houses and the Presidency I really wouldn’t bet against them at least trying, if only for appearance sake.

It pretty much already has if I recall correctly. I think one of the states (Georgia maybe?) was attempting to make it possible to prosecute a woman even if she had the abortion performed in another state.

I know it's not ok to politicize such a personal issue but the GOP have been using 'anti abortion' as a fundraising gold mine for years. They want to get as close as possible to overturning Rowe without actually doing it. If they do it, the 2022 kick back could be severe. This supreme court supermajority is just another sign that they lost control of their own party.

Also, is there a reason there are no national referendums in America? Are there and I've just missed them?

We can't even have a national referendum for President, mate

That's a loser in court. If that held up, it opens the door to insanity like a state with very restrictive gun laws prosecuting one of its citizens for owning a vacation home in another state with less restrictive laws and having a registered assault rifle in that home. States would (correctly, IMO) consider that an infringement on their sovereignty. I can see a district court judge, and even the right circuit court, ruling to uphold. I can't see that surviving if it's run all the way up the flagpole.

@Ruairi77 - There is no referendum provision in the Constitution, probably because the small state delegates didn't trust the large states with respect to a plebiscite any more than they trusted them with respect to proportional representation in Congress. This is also why the Electoral College is stacked the way that it is.

lulz
no

The republicians play for keeps and they can because they keep winning elections.
A slim majority of Republicans are opposed to this, according to polls.

It's possible that this is an issue where part of the Republican base could turn on them. It's not unrealistic to suggest that this could cost them, say, Cruz's seat and the presidency in 2024. This is evangelicals' #1 ask, so it's possible that they could leak some turnout numbers there while flipping some formerly Republican voters and turning out the opposition in droves. I would argue that the Republicans are better off failing to put this through, while appearing to make headway, than they are winning on the issue.

Of course, the Democrats could fail to find direction in the next few months and get crushed next fall, which would put a damper on any hypothetical 2024 gains.

Republicans are playing with fire when it comes to this issue. Less than 30% of the US population supports an abortion ban so if the Supreme Court wants to get political, let’s let them do so and see what happens in next year’s elections. I have the feeling the referendum will be on them.

I'd be interested in the views of the earthen vessels of GOT. America heading inexorably to a theocracy.

I, erm, you know, whatsit thingy.
Nope. I have nothing.
Nothing more than idiots wanting control for controls sake, and attaching themselves to religion to enforce that control. Now tell me again how is that different from other countries and their religious beliefs and making women the focus of such control.

I think we need to go in and liberate the country. Give them some much needed leadership.
