Not punishing Trump would make it far more likely that any politician, regardless of party or level, will claim fraud in any election they lost, refuse to leave office/accept the results and then run again as soon as they can.

Accepting the results of an election and handing over power is the bedrock of democracy, to make challenging that cost free will have even more dire consequences than the damage Trump has already managed to do,

I think that should be fairly easy to achieve in law tbh. Trump made a huge mistake in trying what he did because he looked like a pillock and effectively ruled himself out of being able to run again. Had he taken a gracious approach he would still have the backing of the Republicans, but he blew it......

5 people died that didn't have to die that day. You're trivialising something very serious.

We already have impeachment for abuse of office so seems perfectly valid to use it.

What law has Trump broken in refusing to accept the election results?
 
Why write a new law when you already have impeachment?

He’s already left. This is new ground for the USA. Now if the argument is that it’s worth doing to prove in law that an ex President can be impeached then I would agree, go for it. But of course that would then raise the possibility of impeachment for one or two other ex Presidents...I think it will be a legal minefield, but maybe you’re right.....

Impeachment has been used before on people that have left office, even those that deliberately resigned to avoid getting impeached, It just hasn’t been done on presidents but then no other president has refused to accept the election results or incited a n attack on the Capitol.

It isn’t a legal minefield at all.
 
I think the Democrats and some of you guys are missing the bigger picture. Biden beat Trump, so why are the Democrats and some of you wanting Trump not to run again ? He’s the best opponent you could have, because you already know that you have the numbers to defeat him. If the Democrats get him barred from running, the Republicans might just come up with a decent candidate......
Because he did a coup. This really doesn't take a lot of thinking.
 
Just as a follow up on legal basis for being able to impeach Trump despite him leaving office, this is an excerpt from amletter written by 170 legal scolars.
We take no position on whether the Senate should convict President Trump on the article of impeachment soon to be transmitted by the House of Representatives.

We differ from one another in our politics, and we also differ from one another on issues of constitutional interpretation. But despite our differences, our carefully considered views of the law lead all of us to agree that the Constitution permits the impeachment, conviction, and disqualification of former officers, including presidents.

Our shared conclusion is supported by the text and structure of the Constitution, the history of its drafting, and relevant precedent. The Constitution allocates the "sole Power of Impeachment" to the House of Representatives, and the "sole Power to try all Impeachments" to the Senate. It provides that the "President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors." It further specifies that "Judgment inCases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States."

In other words, the Constitution's impeachment power has two aspects. The first is removal from office, which occurs automatically upon the conviction of a current officer. The second is disqualification from holding future office, which occurs in those cases where the Senate deems disqualification appropriate in light of the conduct for which the impeached person was convicted. The impeachment power must be read so as to give full effect to both aspects of this power.

Impeachment is the exclusive constitutional means for removing a president (or other officer) before his or her term expires. But nothing in the provision authorizing impeachment-for-removal limits impeachment to situations where it accomplishes removal from office. Indeed, such a reading would thwart and potentially nullify a vital aspect of the impeachment power: the power of the Senate to impose disqualification from future office as a penalty for conviction.
 
Based on what we know now, I'd say it is slim.
But if more info comes out - like working with DOJ to oust AG for the specific purpose of tossing out election results - I think we might see more move to convict. Hard to argue his speech was hyperbole when he taking specific actions himself.
It seems President Biden is also having doubts about the GOP voting to convict Trump, but this trial has to happen.
