"The legal risk remains unchanged that if through no such demonstrable failure of either party, but simply because of intractable differences, that situation does arise, the United Kingdom would have ... no internationally lawful means of exiting the Protocol's arrangements, save by agreement."

Game, set and match Varadkar.

Since this was announced less than an hour ago sterling has dropped 1.5% against the €...

He literally says there is no change in the legal risk. No matter what else is discussed, the previous withdrawal agreement is unaffected.

Of course the previous agreement is affected, there are additional agreed legal agreements and a unilateral declaration that has not been objected to.....it may not be what May wanted or even promised, but there is no doubt that it has moved further on...

A unilateral declaration is nonesense. It's an exercise in the UK talking to itself about leaving. They can declare it, doesn't mean it will happen.

I assume it depends how it is treated. It has been raised and added and while not ‘agreed’, it has neither been ‘rejected’ nor ‘objected’ to.....but that’s for the lawyers.....

I was wondering. Because this is basically the same deal.
Legally it’s the same deal that was rejected out of sight.

Now May all along has said she will uphold the Brexit referendum vote and reject a second referendum however here she is putting her rejected deal back through parliament to vote on it again!!!!

Words fail me - the utter arrogance and ignorance of this woman.

It's smoke and mirrors. I'm not trying to be argumentative, but it has little relevance on the terms of the backstop.

It's use is there to ensure that the EU operate in good faith in negotiations.

As I said earlier, the whole of the changes amount to each side agreeing to play nicely.
