It would just tie the Democratic campaign up in a protracted legal process that would inevitably end with the heavily right-wing Supreme Court ruling that him being on the ticket violates the 22nd Amendment.

I don't think the 22nd amendment says anything about being a VP, and Obama wouldn't have been elected president if Biden chooses him as VP. (edit: I should add, I have no idea what I'm talking about...)

I also have no idea what I’m talking about but would it not be an issue if Biden had to step down/died then Obama would be doing more than two terms?

You’re right, the 22nd Amendment technically only disqualifies Obama from being elected President. However…it’s the final line of the 12th Amendment that is problematic here.

But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.
