Ummmmm... Just thinking about this. He still has 13 days in office, and god only knows how much more damage he can do.

But, just hypothetically speaking, let's say that they invoke the 25th amendment and it goes down in history and on the record that Trump was mentally incompetent to hold office...
Now I'm just thinking out loud here: He leaves office and he starts getting indicted for a tonne of crimes, both state and federal.
If his defense team could prove that he has been mentally incompetent for ages, then they could have a pretty good case for an insanity plea!
Basically stating that he never had the mental competency to understand the consequences of his actions.
Amendment 25 would set a precedent, and his defense team would just have to prove that there has always been a pattern of this type of behavior.

Edit: Scratch that! They're circulating articles of impeachment in the house as we speak!

25A doesn't have to mean insane - just that he cannot fulfil oath of office which is to uphold the constitution.
I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.

Inciting a riot to stop a constitutionally mandated election certification is contrary to his oath.

The 25th amendment still takes time. The 20th of January will come before the process is even over.

It will however, and please correct me of I'm wrong, take away the majority of his powers.

25A would be sufficiently fast/effective in this case.

As I heard it explained:
Pence and majority of cabinet sends a letter to Congress; Trump sends letter disagreeing. Pence has 4 days to reply, but has presidential powers in meantime.
Once Pence replies on day 4, Congress has 10 days to do anything.

By the end of that time period, Biden is president and 25A no longer matters.

You can impeach and convict after the fact so that he can never hold office again.
