If he is genuinely worried about any legal problems he may have when he steps down, it may explain why he comes across as so increasingly desperate.

Only works if he has 34 votes in the Senate, which is debatable.

He should be worried, given what has come out. Biden can easily tell the IRS to stand down, let New York make its case public, then 'reluctantly' inform the IRS that such wrongdoing must be dealt with, as no one is above the law.

This may not be a popular take, but at this stage I actually feel bad for him. On a lot of fronts he’s obviously awful, but by all accounts he’s going to uphold his duty today, and he certainly didn’t ask for what is likely coming his way.
