Do we have any Americans on here who'd be able to clarify any legal ramifications of not isolating if he'd received a positive test?
To give you a very basic idea of how this works here:
- It's not a settled area of law and there is very little legislative guidance. McConnell has been trying to get businesses exempted from liability as a condition of further relief, and the Democrats in the House aren't having it.
- Court cases will be filed/are being filed alleging harm done by individuals harming others by infecting them. Both sides will claim there is legal precedent for their position.
- Over years, those cases will work their way through the legal system. Most likely, we will end up with conflicting messages from two or more appellate courts. Eventually, the Supreme Court may (or may not) decide to take one or more cases in order to clarify.
Being realistic, I would be surprised if the Supreme Court held that someone would be liable unless they were intentionally trying to infect someone, or unless they were grossly negligent in some way (eg: had positive test and did not quarantine). Trump's changes to Court composition wouldn't alter my expectations on this issue area, though it is possible that the new Court might cap damages. (Google 'tort reform' for some bedtime material.)
