I think you’ll find Derby haven’t got a leg to stand on. Keogh will get his contract paid up and compo - unless they can somehow prove that, as the passenger, he was liable for the accident which seems very unlikely (and rather hard to prove).
I think you'll find they've explored all avenues, taken legal advice and found he has breached his contract.

If he was a hugely promising teenager I am pretty sure that breach of contract would have been excused. I am no expert, but the 2 lads driving got done for drink driving; he got sacked for being in the back and knackering his knees.

Pretty sure a half decent employment lawyer would be able to present that as a defence.

Not sure. He willingly took a foolish course of action which left him unable to do the job he is paid to do and furthermore caused financial loss to his employer by eradicating any market value his registration and contract may have had. Whether or not he was liable for the accident is besides the point - he got into the car of a driver who he knew was way over the legal drink drive limit and therefore knew it was an unreasonable risk to take.

The other two, by fluke, have not done that.

Today on the radio they were talking about Rooney having to be in form to save them, honestly don't think he will be positive for them in any way shape or form, he should have just retired gracefully after his foray in the USA, can just see him becoming a laughing stock at Derby.

On reflection this might be a case of

Volenti non fit injuria

Whereby Keogh freely entered into a car driven by someone who was drunk.
There is a write up in The Times. He was actually sacked for not wearing a seat belt. He was offered a reduced wage at 3k a week down from 29k. He rejected it and they sacked him on the above note.

Wow, if that's true. If I'd have now been in his position I'd have ripped their arm off for that offer, if he's turned that down after the whole sordid incident he deserves to go but having made that offer to then go right to sacking him may put Derby in an akward legal position, but A. Is it true and B what the hell do I know about legalities....

A mere 150k for a year you're going to spend injured and then retiring... Why would you not take that?
