The denial doesn't make any difference, its a question of how the two laws interact, if it involves personal information the public authority will look to Section 40 (2) FOIA, does it infringe GDPR? It sucks, but it almost certainly will, and that exemption is absolute, there is no public interest test.Normally yes, but he has denied going up there - even if the FOI decision is refused, it would get judicially reviewed and come out that way.
That's not to say it won't come out, just not likely under an FOI request.
