Lets not forget the fact he’s not wearing a seatbelt

Baffling how the Police work in this country at times because, if the fella filming on his phone is getting done, then why isn't Carragher being done? As you said, no seatbelt, he was leaning out of his window, so not paying attention to what was ahead of him, and not in control of his car.

It was like my lad, he was involved in an accident in his car a fair while ago now. He was coming up to a roundabout, it had been raining and was now sunny, he said as he was coming up to the roundabout the sun just bounced of his windscreen and blinded him, he ended going into the back of the car in front of him. The Police came, sorted everything out, even the fella my lad had hit was really sympathetic to him, telling the Police that even when he was driving up to the roundabout the glare of the sun was really bad.

The next day my lad had to go the Police station and give a statement, he said that he wasn't messing with a phone, wasn't doing anything he shouldn't have, said he was just driving as normal, all was sorted.

The accident happened on the 19th December, yesterday he gets a letter through the door off the Police (nearly 3 months after the accident happened) saying that in their opinion he was driving without due care and attention, and saying "I consider it appropriate to offer you an opportunity to attend a National Driver Alertness Course. This is an alternative to proceedings against you in a magistrates Court for driving without due care and attention or reasonable consideration for other road users"

My lad is only 18 like, he's not one to lie, and when he says he was driving as normal and not doing anything that would distract him, I believe him.

He's just had to book himself onto one of those courses, and had to pay £180 odd for the privilege. What has really cheesed him off is that it has taken 3 months for it all to come through after being told in his interview with the Police officer that if they were to take any action he would hear within a couple of weeks of the accident, nearly 3 months later...

Assuming if he's taken this course then he's not getting points on his license or a fine? (although you could argue tot he cost of the course is a fine in itself)

They just said in the letter mate that they believe he may have committed an offence contrary to section 3 of the road traffic act 1988 by:
Driving without due care and attention.

They then go onto say that doing the alertness course will be an alternative to proceedings against him in the Magistrates' court.

So, it's either do the alertness course (and no points on license) or go to court. We've just told him to do the course, and we'll pay for it.

Think the worst thing is for me is that it was a genuine accident, but the Police have decided it wasn't without having any actual evidence.

That sounds pretty classic, usually with relatively minor driving offences if you contest them they back down but make it an absolute arseache for you to do that.

That’s an absolute joke though, especially if the other party corroborated his statement . It’s likely based on his age I would guess

We were thinking about contesting it mate, but we thought the same, with him only being 18 and not driving that long it may be a bit of a ball ache for him to contest it.

The fella he went into the back of said to the Police that the glare of the sun was terrible, and that as he was approaching the roundabout he had the same problem, even with the visor down it was still blinding, and just hit you without warning.

Give the fella his due, my lad said the fella wasn't worried about his car, he just came right over to make sure my lad was okay, no ranting or raving, just more concerned to make sure my lad wasn't hurt.
