Burnley Case

Wasn’t it the same 3 panel that said teams could sue us if we were found guilty back then?
Hope my memory is not going but I seem to remember them actively encouraging teams to sue us if they found us guilty that few years ago.
 
This in bold is part of Evertons argument, that as the rules stand, or stood then, we were in fact compliant with FFP rules on the day Burnley were relegated.

So basically you can be over FFP in spending terms, win 99% of your games, get all your points in the bag, then just before the financial year ends you can sell players to get you within FFP rules. Evertons argument is that you have still had a sporting advantage all season.

Or you could, oh I dont know, do something ridiculous like sell yourself a hotel.
 
Any costs for infrastructure don't get counted on the PSR.

The reason we got done by PSR is that we had the second highest wages to turnover ratio in the whole of Europe for a good few years.

Moshiri gambled on getting into the Champions League and massively failed. The wage bill we had was ridiculous.

We only have ourselves to blame for all this unfortunately.
That's true. But Chelsea and Man City only had themselves to blame as well, yet...reasons.

It doesn't matter how guilty or mismanaged Everton or any club was if there is no consistency of sanction. It's like saying we only had Michael Keane to blame for being a toe offside on VAR when Liverpool and United are awarded goals for being yards offside.

It's "not intefering with play" when it's Liverpool or United (or Chelsea and City in financial terms), but Everton, for some reason, are always suspected of interfering with play...on and off the pitch.

At this point, sanctions are only for the likes of Everton, Forest, Leicester, Luton, and Southampton. Just like the World Cup and "FIFA family" is only for those from the global north.

Yes, the same 3, and your right about them encouraging teams to sue.

They were however, overruled last time (to a degree), and given the implications of what could happen to the rest of the league with everyone suing everyone else on the back of this dangerous precedent, I'd fully expect them to be overruled again.

In all honestly, I'm amazed this hasn't been thrown out before it even gets to these 3 individuals. How can Everton be held accountable for the Premier League delaying the punishment for a PSR breach? That's not Everton's decision to make, so full liability should be on the Premier League for any of Burnley's losses.

In addition, I hope Everton go the step further and counter sue the 3 man panel its self. They are clearly not fit for purpose, and have shown twice now how they can come to a decision that's disproportionately bias against Everton.

No one's being held accountable for the Premier League delaying the punishment, that's not what this case is.

City haven't got away with anything as of yet, they have prolonged this case as they have deep resources and a small army of lawyers.

Premier League have spent over 7 years fighting with City in the courts.

I see your point, but Everton followed rules set by the Premier League at the time. They have since changed their "rules" to have accounts assessed in time to take action same season. This wasn't in place in 2022, so the Premier League couldn't apply any PSR breach punishment that season. That's no fault of Everton, yet we are being sued for their failure. If Burnley want compensation (and why wouldn't they), I don't see how Everton are accountable. You cant follow rules, then a few years later the rules change, and suddenly you've broken rules a few years previous. It dosent work like that.

Everton's punishment is basically irrelevant here, Burnley suggested using the points deduction as a proxy for the extent of the sporting advantage but that wasn't accepted by the commission. What this is is counterfactual reasoning to demonstrate what would have happened if Everton hadn't broken the rules and to identify whether or not Burnley suffered the loss to which the case relates. Someone said alternate realities, that's pretty much all this is. The commission thought Burnley's models and explanations were better than Everton's.
