Messymascot's faith in humanity and ginger safe haven

Another beautiful day down here. Forecast is for sunny and a warm 22 C with light sea breezes. Perfect and unusual for the start of the school hols.

Having myself another BBQ today. Sausages and chicken drumsticks on the menu, together with some Jersey Royals and my ubiquitous tomato and red onion salad. The chicken is from the local shop so it will be free range and hopefully a taste to match the cost.

It's going to be busy down here the next couple of days as we have a wedding and a funeral, both on Saturday. The couple over the road, who just happen to be the cousin of my young next door neighbour, who in turn is the goddaughter of my landlords, are getting married. So my young neighbour's parents, who just happen to be the closest and oldest friends of my landlords, are coming down for the wedding. They will be staying with Sam, who just happens to be their Goddaughter. I know, it's worse than bloody Ramsey Street. lol

On top of that, one of my landlords closest old friends is getting buried on Saturday. The funeral was last week up in Northamptonshire which the neighbours went to. But he is getting buried in his native Cornwall so there is a busload coming down for that, and most are staying in my neighbours. The son is also staying with Sam and she was telling me yesterday that he used to be her beau when they were growing up. See how that one develops. It all seems very incestuous down here. And you thought Wigan was bad.lollol

Anyway, I'm keeping my head down over the weekend.

Hi everyone, hope you're all good, new signings are certainly polarising but it's getting to the point where nobody is good enough for Everton anymore despite us being also rans, crazy, let them play a few games before deciding if they're crap or not, I was guilty last season of doing the same with Gray, who surprised me.

You never know how a signing is going to turn out is the real answer.

Daisy had a nice paddle in the docks, she doesn't normally go in and i don't normally bother as she drinks the bloody salt water, anyway couldn't get the camera out in time, some other pics

The other thing about costs ( and this is a bit technical , sorry Anj ) is that properly advised and if she takes the advice Rooney is likely to have made a Part 36 offer to settle. This is "without prejudice " and in no way reflects "guilt" but she may well have offered Vardy a paltry amount - say £10 k to settle the case. If Vardy fails to beat that offer in any court award she ( Vardy ) will be ordered to pay costs for both parties from the date of that offer.
I hope that happens!

It's been Glorious Goodwood this week and I've been having a daily flutter so have earned my £5 free bet for next week. Have roughly broken even for the week so far so let's hope that continues. ;)
Loads of favourites seem to have won so far. I haven't backed anything this week. Really wanted Stradivarious to win earlier in the week. However I did win a few quid on Pyledriver at the weekend.

I think even if Rooney loses, ( which I hope she doesn't) she will have won in terms of reputation because Vardy has just trashed herself in the proceedings and probably ruined her husband's career as collateral damage. I reckon the judge will say they have to be responsible for their own costs.
Vardy 0-1 Rooney.

Final whistle.

Vardy 0-1 Rooney.

Final whistle.
Not necessarily the final whistle AT - Vardy could seek leave to appeal - but surely even she isn't that stupid.................

From the BBC.....In her ruling, Mrs Justice Steyn said it was "likely" that Rebekah Vardy's then-agent, Caroline Watt, "undertook the direct act" of passing the information to tabloid newspaper The Sun.

"Nonetheless, the evidence... clearly shows, in my view, that Mrs Vardy knew of and condoned this behaviour, actively engaging in it by directing Ms Watt to the private Instagram account, sending her screenshots of Mrs Rooney's posts, drawing attention to items of potential interest to the press, and answering additional queries raised by the press via Ms Watt," she added.

Mrs Justice Steyn continued: "In my judgment, the conclusions that I have reached as to the extent to which the claimant engaged in disclosing to the Sun information to which she only had access as a permitted follower of an Instagram account which she knew, and Mrs Rooney repeatedly asserted, was private, suffice to show the single meaning is substantially true."

She is that stupid Jazzy.

More money than sense.

Would take some guts to appeal that summing up jazzy!

If I was representing her my advice would be ‘take your medicine and it will all blow over soon’.

Excellent result.
I've just speed read the 75 page judgment - nothing about costs that I could see.

However it looks like I was right about the pleaded Defence ...... here's an extract from the judgment .....

On 8-9 February 2022, I heard the defendant’s applications to join Ms Watt as a part 20 defendant, to file a Re-Re-Amended Defence and for disclosure orders; and the claimant’s applications for further information and disclosure orders. I gave judgment on 14 February 2022, dismissing the application to join Ms Watt, granting limited permission to amend, and making specific and supplemental disclosure orders against the claimant: Vardy v Rooney (3) [2022] EWHC 304 (QB).

So in plain and simple terms ,

1 Rooney's lawyers realised that the original defence was either poorly drafted or information came to light after the exchange of statements I guess that led them to the view that Vardy's agent Watt could be responsible.
2. The application to join Watt as a party was thrown out because it was too late and too close to the trial. She was however given permission to amend her defence ( for a 2nd time !)
3. Rooney won the case in any case because the Judge found that Vardy was less than truthful ( she puts int much nicer than that ) and that the original Defence that Vardy spilt the beans was true because she had actually told her agent to do so ( rather than the agent going off on a frolick of her own )
4. Rooney won't get the whole costs because a) they are disproportionate to the issues and b) she lost interlocutory hearings ( like the one in Feb 2022 - above for which Rooney will have to pay.

Hope this helps lol
