Supposedly you make the decision from when the player who is fouled gains the most advantage, ie in the box, the funny thing is though he doesn't get touched in the box, the foul is outside the box so as you say is a free - kick. Also, when the ref is looking at the monitor the penalty decision had already been given by VAR, the ref was only checking to see if it warranted a red card.
