They look very similar if I'm honest and I for one would not like to pick which one is which in a Police identity parade. Hasn't this guy got form for this type of thing ?

Fair enough, what needs to happen now is the original guy should be brought to account. If it's a genuine mistake and looking at the pictures, it may be, an apology should suffice, if it's malicious intent, then it's a legal issue. Apologies if I've unwittingly wronged someone.
