There are a couple of lawyers who post in the thread who would have more knowledge than I, but my understanding is that if the NDA covers something that is illegal then the NDA is unenforceable. I generally think that NDAs, although useful in many contexts, can be abused by the powerful to avoid accountability for wrongdoing.

I cannot even think of a democrat politician who used to be a real estate developer so will not be able to come up with one who was charged for crimes related to that activity.
