James Comey's own words. You do not get much more intentional than setting up your own private email server and using it to send intel documents, no? This was not misplacing a few intel files. Discretion was used by Comey. This discretion unsurprisingly sided for the benefit of Clinton.

Everyone is liable to be mistaken about certain things based on their political preferences, don't waste anymore of your life defending a man who cares about nothing except himself.
All the smart conservatives have pivoted to "prosecuting a former President is crossing the rubicon" because that is the only defence left based on the evidence which is public record and you can see and hear for yourself.
 
Obviously, this is a bit more nuanced than a soundbyte from 2020.

I wouldn't be remotely surprised if numerous intelligence & law enforcement agencies were analysing an incoming President Trump in 2016. All recent President-Elects have either been part of the "Washington Establishment" or (and this is now receding into memory) held high rank in the military. Either of those are positions of Federal reponsibility and the agencies involved will have a first-hand view of the man assuming the Office.

Bankrupt reality TV host Trump turns up, wins the election. He's had no real first-hand contact with Federal agencies but does have a disreputable history and well-publicised financial links to foreign nations, not all of whom are historically 'friendly'. You'd be mad not to have a gander at potential national security implications of this wildcard newcomer.
 
I'm just happy that "But her emails" is getting a 2023 remix rerelease as there's no new material.

Seriously, the issue that GOP have here:

1 - The 'victims' (for want of a better word) are the Government agency literally charged with record-keeping. It's not like they're unreliable witnesses, they know exactly what was missing and have no reason to lie about any of it. The retention of these documents is routine stuff, and they probably reported the lack of response from Trump's people to the FBI thinking it would just expedite the return. The evidence handed over by Trump's lawyers trying to deal with the request (in good faith) completes the picture and points unerringly to Trump's guilt in the actual crime, not of retaining the documents in the first place, but his ongoing efforts to keep hold of them and lie about doing so. In summary: Trump is clearly guilty.

2 - It's been downplayed, but Trump holding on to state & nuclear secrets that involve foreign governments put numerous American personnel at risk, from the armed forces to intelligence services. It's hard to stake an "America First" claim when your actions literally endanger the Americans at the sharp end of protecting America. The GOP being all about veterans (snigger), national security & the military are defending a man who might have thrown them all under a metaphorical bus, or got them thrown out of a literal window. In summary: Trump has endangered American lives (you know, in addition to the ones who shone UV torches up their asses to fight off their Covid infections on his televised recommendation).

3 - Significantly, Trump's MAGA base is still important for any GOP electoral prospects in battleground states, and so any alternative presidential candidate, or even House/State representative, have to be able to toe the fine line of outrage over Democrat overreach without nailing their colours too firmly to the 'Trump is innocent' flag. So instead it's all "But her emails" and "We don't prosecute political opponents" without engaging with the substance of the indictment and being taken down with him should a guilty verdict be forthcoming. In summary: Continued cowardice.

All great points, to be sure. Unfortunately, I would add that it is tough to convince most of the MAGA dipshits here and elsewhere of your points because they don't really believe in evidence, facts, or reality. A lot of them are evangelical Christians (at least that's what they wear on their sleeve) and thus actually don't GAF about their actions on this planet, hence their clear intents to destroy all that supports them, as they believe they'll be sucking non-alcoholic margaritas in the white cloudy sky-fairy McMansion for eternity.

[edit: I got no truck with religious people overall (though I am strongly skeptical of religion and its largely anti-positivist stance), only those who are hateful selfish rhymes-with-runts who cling dogmatically to a closed-mind--to be sure, this latter criteria actually excludes a lot of religious folk that I respect, despite not sharing their belief in a god/gods/afterlife]

True, but the "MAGA dipshits" aren't a majority of the electorate. The problem I was alluding to is how the GOP reaches out to the political middle ground necessary to win a general election when they're so clearly struggling with their messaging over this. Is Trump actually innocent? Most of them won't answer. Do we support him anyway? Unreservedly!

Although who knows? I'm not American, and maybe the average Yank/Dixie really is that stupid and falls in line in 2024.

Anyways, back to reality, this is what is obvious to so many, but also lost on so many others: anyone who spends time with Trump will eventually find him to be odious and horrible (the track record of former Trump associates who say this is the only recommendation that it needs). Only the most obsequious, spineless, sell-their-soul-for-money/notoriety clowns will suck up to him, like that pillow idiot. But that's because they haven't been around Trump long enough for him to scapegoat them via some bullying tweets as he throws them under the bus so that the MAGA dipshits can troll and defame them on Parler/Twitter/Truth Social, etc. Trump is pathologically committed to his own narcissism and his only gift is that he is able to, puzzlingly and temporarily, convince others that he is worthy of their extolment about him.

And when told to give them back by the government and their own lawyers, they ask their chauffeur to just move them to one of their "I'm totally a man-of-the-working-class-little-guy" thirty-three bathrooms, and then brag about it to visitors and lie about it to their own lawyers and government officials. The whole thing smells.

That's the best bit for me, that working class people think he represents them. He doesn't give one crap about any of you lol.
