If I had to guess, they were waiting to see if they could continue to run this through the House. The lengthy internal debate at Justice was probably over whether or not they had the goods if the expected loss did occur. It's probably a marginal case by Garland's standards, but he's not the sort to run with it unless he thinks he has enough to get over the line.
