Don't get me wrong, I don't want a wall, but I can't figure out why he's not using executive order to fund his wall.
The shutdown is hurting both him and the country.
Anyone who'd object to his use of an EO to fund his wall, would object to him anyway.
It's almost if, as soon as the dems took the house, he's intentionally grinding the country to a halt.
Must make Putin very happy.
Does it definitely fall within the scope of what could be done with an EO? At a guess I’d say he’s probably been told it would have no chance of standing up in court.

I've learned more about how government works in the last two years than in the previous 40 of it existence.

He CAN'T do an EO because the $$$ is controlled by Congress. Congress has to pass funding for just about everything in regards to the running of the government.

I could be wrong here but I'm fairly sure an EO is the only way he can raise funds without the OK of congress. But as Birkenheadblue points out, it'd likely be tied up in the courts for ever.
Plus the GOP railed hard against Obama for using EOs on immigration.

It can't. I'm on the road right now but an EO to approve the wall isn't the same as securing funds

Isn’t declaring a national emergency a bit different to an EO? Same outcome, admittedly.

And even when the Emergency measures were being discussed, it was made pretty clear there’d be a million legal challenges - particularly around having to prove it’s an emergency, when border crossings are at something like a 40yr low.

Just my opinion based on reading the situation via right wing outlets, but I think it's boiling down to a realization that it's a Pandora's Box that would blow up in their face.

Climate change as an example (which is an actual crisis) could be used as a national security emergency and it would be likely a lost cause to try to challenge it in court. There is a mountain of data to back a declaration of that emergency...unlike the bogeymen coming from Mexico.

Yep, a "national emergency" is different to an EO. He could, in theory, do that.

But come 2020 the next mass shooting that occurs the Democratic presidency use the same "national emergency" for a legit reason like gun control or climate change. You know, an ACTUAL "national emergency".

Nothing I'm aware of.

Each of the 100+ emergency powers vested in the Executive "lies about like a loaded weapon, ready for the hand of any authority that can bring forward a plausible claim of an urgent need." - Justice Jackson in his dissent to Korematsu v US, the SCOTUS case that upheld internment of Japanese Americans during WWII. Trump could literally call a national emergency and shut off electronic communications or freeze the bank accounts of every American citizen. It is entirely conceivable if he did not like what he thinks might be the results of the 2020 election he could declare a national emergency and change the narrative.

Most Western democracies have specific situations spelled out how and when the Executive can declare a national emergency along with which specific rights can be suspended. The US Constitution isn't very specific about this. Lawsuits can be filed to try and stop him and surely would. But given McConnell has packed the courts with Federalist Society members is anyone comfortable with the courts checking the powers of the President?
