Quit you two. It can be both required by State law and refuted by SCOTUS. That's how these things work, independent branches and such.

Trump is obviously clinging to the hope of people who haven't pledged their allegiance for one side or another to vote for him today. The silent voters, those too embarrassed to tell their family and friends they'll be voting for Trump, those who simply don't want to have to explain themselves to others. There must be absolutely millions of them. I know I couldn't be arsed having to explain myself about Brexit ...
