DC Comics Suing Valencia

And as per the OP - thats the actual batman logo. You cant just rip off a logo coz its an animal. Playboy, Disney, Puma.. you can’t just pinch a logo because you have been around longer.
It's not pinching though is it? DC don't hold exclusive right to the image of a bat FFS! If somebody used an image of a mouse it wouldn't be pinching anything off Disney unless they put the dam thing in red shorts and made it obviously Mickey Mouse. This whole story is the most blatant example of the stupidity, arrogance and greed of corporate America.

Lets be honest, physical comics will probably go the way of most physical entertainment - dvd, vhs, vinyl etc. Its going to be around in some form but not how it has been succesful in the past. To say Marvel comics is on the brink of closure is ridiculous. Its literally the biggest brand in entertainment. It will just evolve.
Marvel entertainment is a power house, I'm not disputing that but the comics division really is on the brink of closure, that's a very real worry. Sure you can argue that comics currently are the same as DVD's and Vinyal's and will be saved by the smaller collector's market. The problem is they have a much, MUCH smaller pool of buyers with a much, MUCH larger selection of products that are going unsold due to the terrible writing and mostly mediocre art. There's been very real talk of transitioning into working on novels and OGN but leaving monthly single issues behind. Now it might never happen, but the very fact that it's even being talked about is incredibly sad imo.

If you didnt know Valencia was using that logo what would you say it was? Valencia?

Okay lets put it this way. Theres a company called ‘Three Black Circles’ and they decide to use this logo.

Do you think this would stand up in court if Disney saw this? Its 3 black circles by design, but very different in global recognition.

It's diffent now, the comics division isn't a priority anymore. They're currently corporate powerhouse with a single division that is continually losing money. It's not about the company going under, it's about the company cutting cutting a division that is unprofitable.

DC comics certianly wouldnt be the first thing that jumped out at me on seeong the logo and if it doesn't jump out in me, a massive comic nerd and a huge DC comics reader then I very much question how much it would ever occur to the vast majority of people.

Has 'three black circles' always had a somewhat similar logo though? Do they predate Disney? If the answer is yes on both counts like it is with the Valencia then they have nothing to answer in court.

Never going to cut the creative division of the company. And besides, its the distribution model thats inherently flawed. That will change, the delivery of the medium will be digital and graphic novels will still being popular.

If you could argue that Batman had originally copied Valencia, you’d have an argument, but as it stands I don’t think Valencia can really use a stand alone Bat logo as its too similar to Batmans. Put these colours and a footy on it and its fair.

When did DC comics purchase the exclusive rights to the images and likeness of a Bat? They own nothing of the sort. Valencia have no case to answer in court or anywhere else on this issue.

The situation isn't incomparable at all. If this was another comic company deliberately copying DC then you'd have a point but it's not.

Knowing the Ton we'd end up losing and forfeit the right to use our own logo!:dodgy:

The distribution model is very flawed, on that we agree.

We'll have to agree to disagree on the digital medium, that will result in the slow death of the industry alltoghter.

OGN and novels will be the way forward but weekly, monthly and anything else contained in individual issues will disappear sooner rather then later unless the people who run this companies stop creatively stiffening writers and learn that their movie audience isn't necessarily the same as their comic audience.
