6 + 2 Point Deductions

You can't just put "we can do what we like and you can't sue us" in a contract and make it so. The law of the land is paramount and you can't exclude it, even if the other party signs the contract. They wouldn't necessarily intervene on the actual merits of the tribunal but I'm pretty sure the courts could get involved if the process has been unjust.

That would be a very high threshold though wouldn’t it? For a process we agreed to. I just can’t see it would ever happen. Wouldn’t we get into serious trouble fir breaching PL rules???
I'm not sure about thresholds but yes we'd need serious grounds for the courts to step in. The legal opinion that was shared on here the other day about the human rights aspect of the process did indicate a possible path the courts would definitely get involve us.

I don't think the PL could really punish us for going to court if there were reasonable grounds to do so - in fact if they did so it would help make our case that we were being treated unjustly.

It's a last resort because it would become pretty messy, but we should at least maintain the threat of doing so, as City did today putting it out there they could go to court over the related party rules.
 

Well stuff like the abuse of process stuff Andy Burnham raised and the DCMS followed up on. That would be a main argument, or issues around the actual independence / impartiality of the panel.

Procedural stuff, basically.
That’s what the independent appeal is for though.
Look. I’m not disagreeing with your purpose or morality, I just think the what you’re asking for is fantasy in the real world

That was unlawful under employment law. This is a points deduction for breaking sporting rules. Even if we see this as unjust it’s a huge huge hill to climb.
it may be unlawful on restrictions of trade. How can it be right that a shady closeted organisation can tell a private company how much its owner can or cannot invest in his own company? Bosman ruling came about when the club rules were tested against proper laws, this could well be the same

Because the private company willingly singed up to abide by those rules!
To go to court would be absurdly hard and would probably end up even worse for us. I don’t want that!!
 
Just imagine for a second, the minutes and attendees had some of the sky 6 there in the meeting. The whole league would blow apart

Can we not force them to release the minutes. Shouldn't the onus be on the PL to prove that they didnt influence the commission?

How can we be sure its independent given the info thats out there now.
I do believe them that there are no minutes, which is worse....they want to make sure there's no evidence. But It's a boys club, not the government, they aren't legally required to keep minutes and probably don't need to. "How many points should it be? 10? OK meeting over, someone tell the commission" is the only action.

Only way we try to go to the courts is if we're not part of the Premier League anymore. If we stay up after both charges have been heard we'll be thanking our lucky stars it happened this season and try to forget about it.
