6 + 2 Point Deductions



Surprised at this, I assumed everything was boxed off at this point but clearly not.

I'm not an expert, but I can't see how Burnley can seek damages from Everton.

The governing authority is the Premier League, and it was according to their procedures and commissions appointed by them that we were found in breach and got the points deductions.

Those deductions could have been absolutely ruinous for us, they were unprecedented and heavy punushments. It's not Evertons problem as to the timing of them.

At what point does Everton seek damages? When will it be our turn? Do we claim for Clive Thomas, for Heysel, for Pierluigi Collina. Do we claim the Premier League damaged our reputation when it accused us initially of not acting in good faith, which they later retracted.

Should we ask the taxpayer to contribute towards Bramley Moore as Utd will do for their stadium?

This is madness.
 

They have got no case whatsoever against Everton as it was the league who decided on the timing of the hearing and they should be laughed out of court.

Did Chelsea not get away with punishment for some under the table payments as “it was under previous ownership”?

But agree, this is on PL. we’ve taken our medicine
 
How’s this a PSR issue?
Well we’re apparently being sued by at least Burnley over our PSR breaches and its affect on them. This is due to go to court in the summer.

We’ve retained the services of the KC who represented us at the PSR hearings to defend us in said action.

Moyes said “I don't know all about PSR, but I do know we've still got some work to do in the summer. I was aware of it when I came in, but I'm hoping that we're going to stop thinking about that now and begin to start thinking about how we're moving forward.”

Think that can fall under the ‘PSR issues’ umbrella surely?

Was this the season when the PL said we had ‘no case to answer’ having accepted all of our Covid mitigations, or the season where we should have had a points deduction but the PL’s incompetency caused the deduction to be delayed by a season?

Burnley weren’t even in the league that season. So actually they benefitted from the league’s decision to delay, as we ended up getting our deduction in 23/24 when they were in the league. Sadly they were so embarrassingly bad that they still finished below us and went down anyway. Not our problem really lads.

We had 8 points deducted and still finished 16 points above them.

Exactly, which makes me think that the litigation could possibly relate to a period before Everton were ever charged with a PSR breach. The only season that Burnley could possibly be whinging about would be the 21/22 season, when the PL said we had no case to answer following the application of Covid rules.

There were some clubs suggesting we should be hit with PSR the year before, but it's up to the PL to bring charges. They didn't.

Quite why Burnley think they know better is beyond me, and if they should be going after anyone it's the PL.

There’s a few intangibles though I guess, which doesn’t exactly make for a strong case still…..
Arguments they could use are they abided the regs and had they not, they could have
A) beat us twice, gaining them 6 points and reducing the deficit to 4 points as we would lose also be 6 points worse off
B) only breached PSR 1 therefore only getting a 6 points penalty (putting them 10 points off is)
C) having improved the team beyond PSR limits, they could have won 3 more matches leaving them 2 points above us.
D) Argue that had we not breached PSR we wouldn’t have been so far clear and might not have beaten them twice or had some of the other wins or draws etc (assuming we did - cba checking!)


All very hypothetical / speculative, but just that’s the point, it’s hard to say what could or would have happened and likely why they are trying to sue.
