The PL made recommendations for 12 points but the decision to deduct 10 wasn't made by the PL.

I don't think there's an argument that it definitely was arbitrary either....it was due to breaking spending rules and until further similar cases are heard and decided on I'm not sure how it can be described as arbitrary. There would have been a reason for reaching that particular figure.
