I don't know about legally but it'll be hard for a prosecutor to press charges when the defense brings up the small point of a robber being in your home. Usually the cases get referred without charges.

You have the right to defend your home and your person, with deadly force I might add.

Just make sure they're in your home.

If you shoot 'em out in the front yard, you might have some legal issues.
