Plus I doubt Pardew will accept losing him to Chelsea without another striker in return ( Sturridge?)

If Chelsea want him, and apparently there were talks today, with his buyout clause of "only" £7m, cant see the Sturridge deal being a problem for them.

They can't sign him until 1st January. If he can't put pen to paper they're not going to announce a new signing. Pardew has no say in what happens with Ba. Once a club meets the value of his release clause they are obligated to let him go.

They've got four days to finalise the deal with a fee already agreed. So it's four days to iron out personal terms and this is Chelsea not us.

They can sign a player whenever they want, the player just can't join until 1st January.
