Not really.

It’s highly likely that whatever punishment comes from the 2nd charge will be significantly less than the first (because 2 of the 3 seasons have already been dealt with/punished).

Forest almost certainly have to get at least as big a punishment as whatever we end up for the first charge.

Let’s say we don’t get any points back.

Everton 1st charge: 10pts
Everton 2nd charge: 3pts
Everton running points total: 17

Forest first charge: 10pts
Forest running points total: 15

And that’s a fairly pessimistic outlook (if we don’t get any points back on the first I think it’s unlikely we get ANY points for the 2nd)

So what in that scenario tells you that we definitely don’t get relegated? As well as it being pure conjecture.
 
I’m all for this ‘double jeopardy’ defence, but I think it’s a very weak one. The reason the assessment period is over three years, is because it’s seen as a reasonable amount of time to get your affairs in order.

You can’t have a club going mental in the transfer market for two years, and then demand that only the third and final year is taken into consideration when adjudicating these rules.

I hope it works that way, but it would be a bit daft if it did imo.
 
Why not?

Surely it can be whatever they want because there is no official sanction policy, and it's up to the commission to decide.

More than likely we are appealing the severity of the punishment, not the verdict.
They clearly used the method the PL wanted so they can just reduce it by 2 points
