6 + 2 Point Deductions

This text, in my opinion, is setting out that this case will not set a precedent and that all future cases will be treated and punished/unpunished on their own merit. It gives the ability for any other gathering to come to a completely different conclusion, with no boundary of range.

There is no fixed formula to be applied: we are required to determine the extent of the culpability, and from that to determine the points deduction. That requires the exercise of our discretion as a specialist panel, and a determination to be made based on all the facts of the case.
Some of it will act as precedent though, e.g. the sporting advantage malarkey. If that gets through our appeal they'll be using it again for both us and Forest. Personally I think the rules as they are warrant a range of options as a punishment because of the differences in theoretical ways in which the rules can be broken; I'm not sure it's a power thing.

I remain hopeful that the commission just made a poor decision (or series of) under influence by the Premier League and it'll be righted in the appeal, but it's so easy to be sceptical.

Any judgement of points deduction should have been voided when the PL recommended their 12 point deduction, to an independent committee.

Hundreds of millions have been lost in the January window as teams are scared of breaching the rules. Add to that the multiple millions that Sly Sports and other media outlets worldwide have lost, in what was a deadline day non-event. Money Talks and this joke of a league will be under a lot of pressure, from the Money Men, to reopen the the multi million pound flood gates. I reckon a fat fine and possibly a transfer ban.

I dont think a fine or a Transfer ban would act as a deterrent.

In the EFL they take points, so thus a points removal would be a fair punishment.

Given the mitigation and our frugal spending, I would be wanting it suspended.

But no problem.
A transfer ban is a big deterrent and doesn't undo any results on a football pitch. It might well have a big impact on how a team performs, but the result would still matter and wouldn't be changed after the fact.

It's a far far preferable option than deducting points a team has already earned.

We've created more than enough for a mid table team tbh.

The problem has consistently been lack of quality in front of goal and well below average finishing
12th in the league in terms of XG.
That’s 15 goals lower than our. XG that we’ve scored.
That is almost unprecedented.
The good news is that it’s got to turn better at some point, because this is the coldest of coldest streaks ever.

I tried to post the churchcourt chambers article earlier, but it wouldn’t let me post the link. As you say, it is hopeful on the basis of what this person has written that Rabinowitz has taken them to the absolute cleaners. Let’s hope so. The bloke who has written that article seems legit with strong credentials.

No guarantee it eventually turns around unfortunately. A lack of quality is the main reason we don't score enough. Yes there is an element of bad luck at times but also we haven't been good enough
